Understanding Texas LTC vs. Constitutional Carry

in

Even though Texas enacted Constitutional Carry (permitless carry) in 2021, obtaining a License to Carry (LTC) still offers substantial legal, practical, and geographical advantages.

The primary benefits of maintaining or getting a Texas LTC include the following:

1. Reciprocity with Other States

While constitutional carry allows you to carry a handgun without a permit inside Texas, that privilege disappears the moment you cross state lines into a state that doesn’t have permitless carry laws. A Texas LTC gives you reciprocity in dozens of other states, allowing you to legally travel across the country while continuing to carry.

2. Faster Firearm Purchases

When you have a valid Texas LTC, you can completely skip the National Instant Criminal Background Check System (NICS) background check when buying from a licensed gun dealer (FFL).

  • LTC Holders: Simply fill out Form 4473, present your license, and walk out with your purchase.
  • Constitutional Carriers: Must wait for the NICS background check to clear every single time, which can result in unexpected delays.

3. Access to More Locations (Avoiding 30.05 Signs)

Texas law allows private business owners to prohibit permitless carry quite easily by posting a standard 30.05 sign or even a basic “no guns” graphic.

  • To bar an LTC holder, a business must post highly specific, legally worded 30.06 (for concealed carry) or 30.07 (for open carry) signs.
  • Because many businesses only post 30.05 signs, LTC holders can legally carry in many establishments where constitutional carriers cannot.
  • Furthermore, LTC holders are generally permitted to carry at open meetings of governmental entities, which are off-limits to unlicensed carriers.

4. Federal Gun-Free School Zones Protection

Under the federal Gun-Free School Zones Act, it is a federal crime to carry a firearm within 1,000 feet of a school’s public property unless you possess a license issued by the state.

  • LTC holders are exempt from this restriction when driving by, dropping off/picking up students, or parking near schools.
  • Constitutional carriers do not have this state-issued exemption, meaning they could technically violate federal law just by driving down a street adjacent to a school with their everyday carry.

5. College Campus Carry

Texas Campus Carry laws allow individuals to carry concealed handguns on public university and college campuses. However, this right is strictly legally reserved for LTC holders. Constitutional carry is entirely prohibited on college campuses.

6. The Airport “Get Out of Jail Free” Courtesy

Accidents happen. If you inadvertently bring a handgun into an airport security checkpoint:

  • LTC holders are granted a legal safeguard under Texas law. If they immediately leave the secured area upon being notified of the weapon, they can avoid arrest.
  • Constitutional carriers do not receive this statutory courtesy and can be immediately arrested and charged with a felony.

7. Clear Rules for 18-to-20-Year-Olds

While constitutional carry eligibility can sometimes be legally complex or restricted based on age and local interpretations, federal court rulings forced the Texas Department of Public Safety (DPS) to issue LTCs to eligible young adults aged 18 to 20. Having the physical license provides ironclad proof that an 18-to-20-year-old is carrying legally.

The Bottom Line: Constitutional carry is highly convenient for basic personal defense within Texas state lines. However, an LTC acts as a layer of legal armor, granting you broader location access, smoother law enforcement interactions, faster buying power, and interstate freedom.

8. Protection when accidentally carrying in a bar

In Texas, the “51% Rule” refers to a strict statutory prohibition regarding firearms and establishments that sell alcohol. Under Texas law, it is a strict criminal offense to carry a firearm onto the premises of a 51% establishment. Violating this law is a Third-Degree Felony, which carries a penalty of 2 to 10 years in prison and a fine of up to $10,000.  If a 51% establishment fails to post the required red sign, and an LTC holder walks in with a concealed handgun without knowing the business is a bar, the lack of signage acts as a defense to prosecution. If they genuinely didn’t know, they are generally protected. Unlicensed carriers do not get notice protection. Under Texas law, a constitutional carrier can be charged and prosecuted for a felony if the establishment statistically qualifies as a 51% location, even if the business completely failed to post the red sign.
